Artificial Intelligence Law & Legal Services

Early applications of Artificial Intelligence (AI), such as machine learning, have been with us for a while but the advent of generative AI has made us all recognise the power of the technology and the risks of unregulated or poorly controlled use.

The legal issues associated with this potent technology are complex, as specific new laws and regulatory models are being brought into effect, supplementing existing laws which already apply to AI.

Whether you are a developer of AI or are a business considering its use, or you are already using the technology, our multidisciplinary team of sector expert lawyers can support you on the full range of legal requirements and we can advise on the rapidly developing types of complex issues that you may need to consider.

Our Artificial Intelligence Law & Regulation Services

We can assist you in the following areas:

AI Regulatory & Ethics

We provide guidance on regulation and AI policies and impact assessments to ensure adherence to existing and forthcoming legal and regulatory frameworks. Our aim is to assist clients in understanding and complying with emerging AI regulations, facilitating the safe, ethical deployment of AI technologies while mitigating the risk of discrimination.

Contracts - Terms of Business and T&Cs

Our expert commercial lawyers provide support on providing model agreements for the use and exploitation of AI and assistance with contract negotiations for both suppliers and customers of AI based services. We also advise on contracts for procurement of processing capacity and technology infrastructure for the hosting and processing of AI workloads.

Commercialisation and Protection of IP

Our services include advice on the licensing of copyright works for the training of AI models, IP implications of the training and use of AI to generate content, including in relation to subsistence of rights and assistance on potential infringement of copyright and other IP rights by AI providers and deployers.

Corporate (including Investment & M&A)

We advise funds and investors investing in AI based businesses as well as sellers of AI consulting and AI technology businesses. Most businesses will also deploy AI, so it is becoming an increasingly important feature of every M&A and investment transaction.

Consumer Law

We can help and advise on what information should be provided to consumers, consumer rights and redress where consumers are impacted by an AI based decision.

Data Protection

We provide advice on the data protection aspects of developing and deploying AI, including advice on AI explainability, data protection impact assessments and data subjects’ rights.

Disputes

Resolving AI-related disputes requires specialised legal advice from experts keeping pace with the unique and dynamic environment AI technology operates within. We offer advice on the full range of AI-related disputes especially in relation to Intellectual Property concerns, breach of copyright claims and regulatory disputes. Our team regularly advise on cross border disputes and have expertise in both national court and arbitral proceedings relating to AI content and systems.

Employment

We deliver specialist advice on the potential benefits and  risks of using AI in the employment context, including implementing appropriate polices and procedures and avoiding or managing risks and claims that may impact an organisation’s compliance with employment laws and regulations.

Our AI Law Business Guide

We recently published our AI Business Guide which aims to help both in-house lawyers and senior executives in improving their understanding of AI and some of the key legal issues associated with it. The Guide includes contributions from practice area experts from across the Firm to provide a perspective on the legal implications of AI and how the rapid development of different types and branches of AI creates additional and more complex issues that require consideration.

The EU AI Act: A Beginner's Guide for UK and International Businesses Using AI

Following on from the AI Law Business Guide, our Beginner's Guide to the EU AI Act offers a comprehensive overview of the EU AI Act and its effect on businesses utilising AI technologies. The guide clarifies which businesses fall within the scope of the Act, the types of AI subject to regulation, the timelines to comply and the consequences of non-adherence. It also provides details on the Act's risk-based approach to regulation and sets out obligations in relation to each category, with practical steps to take to ensure conformity with the Act's requirements.
